BANKRUPTCY GUIDE

CAN I STOP A GARNISHMENT AND/OR LAWSUIT AGAINST ME?

The answer is Yes!!

When a Bankruptcy is commenced, the federal district court issues an automatic stay under section 362 of the Bankruptcy Code.  An Automatic Stay is like an injunction. It orders a creditor to cease any cause of action on which they are proceeding in another court.  The State of Illinois amended its exemption law recently. Now a creditor may keep any wages from a wage deduction they have procured prior to the filing of the bankruptcy.
