BANKRUPTCY GUIDE

CAN I BANKRUPT MY CHILD SUPPORT?

Basically, the rule is, child support is never dischargeable in a Chapter 7 Bankruptcy. If, however one is in arrears on child support payments, a Chapter 13 case may be recommended.

A Chapter 13 could allow a Debtor to make his normal weekly or monthly child support payment and then pay off the arrearages over a period of time, typically 36 to 60 months
